1. Introduction

Welcome to DPP Platform — Self-Hosted Edition ("Platform", "we", "us", "our"), a software product of AI Group LTD ("Company"). These Terms of Service ("Terms") govern your license to use our Digital Product Passport software, including source code, documentation, and related materials (collectively, the "Software"). The Software is installed and operated on infrastructure controlled by you, the licensee.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

3. Definitions

  • "Digital Product Passport" (DPP) — A structured digital record containing product information as required by applicable EU delegated acts under Regulation (EU) 2024/1781 (ESPR).
  • "Tenant" — A registered business entity using the Platform to create and manage DPPs.
  • "User" — Any individual accessing the Platform, including tenant representatives and public consumers.
  • "Public Access" — Unauthenticated access to DPP data via QR codes, URLs, or API endpoints.

4. Service Description

The Platform provides:

  • Self-hosted software for creation, hosting, and management of Digital Product Passports
  • Ed25519 cryptographic signing for data integrity
  • Role-based data access tiers (consumer, recycler, regulator, operator)
  • JSON-LD API for machine-readable DPP access
  • QR code, DataMatrix, and PDF label generation
  • Audit logging capabilities

You are responsible for provisioning and maintaining the server infrastructure, backups, security patches, and ensuring 10-year data retention as required by EU ESPR Regulation 2024/1781.

5. License & Account Registration

The Software is licensed under a perpetual license. You receive a non-exclusive, non-transferable license to use the Software on infrastructure you control.

The license fee is billed via invoice (bank transfer). Annual maintenance and support plans are available separately and billed annually via invoice. We reserve the right to suspend support services for non-payment.

6. Data Ownership & Responsibility

You retain ownership of all product data processed through the Software. You are solely responsible for the accuracy, legality, and completeness of your DPP data.

You are the Data Controller under GDPR for all personal data processed through your self-hosted instance. AI Group LTD acts solely as a software provider and does not process or access your data unless explicitly requested for support purposes under a separate Data Processing Agreement.

You warrant that you have the legal right to publish all information in your DPPs, including trade secrets and proprietary information marked as such.

7. Acceptable Use

You agree not to:

  • Use the Platform for illegal, fraudulent, or deceptive purposes
  • Upload false, misleading, or intentionally inaccurate product data
  • Attempt to circumvent access controls or security measures
  • Scrape, crawl, or overload the API beyond reasonable use
  • Infringe on intellectual property rights of third parties
  • Upload malicious code, viruses, or harmful content

8. Data Retention & Deletion

You are responsible for retaining DPP data for a minimum of 10 years from creation, as required by EU ESPR Regulation 2024/1781, on your own infrastructure.

After the retention period expires, you may anonymize or delete data in accordance with your own GDPR compliance procedures.

9. Intellectual Property

The Platform, its software, design, trademarks, and underlying technology are the exclusive property of AI Group LTD. You receive a limited, non-exclusive, non-transferable license to use the Platform in accordance with these Terms.

DPP data generated through the Platform remains your property. We claim no ownership over your product information.

10. Limitation of Liability

To the maximum extent permitted by applicable law, AI Group LTD shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Errors or inaccuracies in DPP data uploaded by tenants
  • Service interruptions caused by factors beyond our reasonable control

Our total liability shall not exceed the amount you paid for the Services in the 12 months preceding the claim.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Bulgaria and the European Union.

Any disputes shall be resolved in the competent courts of Sofia, Bulgaria, unless mandatory consumer protection laws require otherwise.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or Platform notice at least 30 days before taking effect. Continued use after changes constitutes acceptance.
